Tax Planning for the Affluent Investor

With the introduction of the Net Investment income Tax (NIIT), the 20% capital gains rate, the 39.6% income tax rate, and the PEP and Pease limitations, America shifted overnight from a two dimensional tax system to a five dimensional system. Virtually every financial decision now needs to be analyzed through this new lens. The complexity of going from a two dimensional system to a five dimensional system is exponential, not linear, which requires a quantum leap in tax analysis methodology, tax strategy and tax planning software tools. The new norm requires practitioners to understand tax driven strategies. At the forefront of these planning strategies to help navigate through the new five dimensional tax system are Tax-Efficient Investing and Bracket Management. In this presentation, you will learn: 1) Bracket management planning theory, including tax brackets, phase-out of itemized deductions and personal exemptions, the AMT, the NIIT, “Tax asset classes”, capital gain and loss harvesting, and AGI contingent Medicare premiums; 2) Tax-efficient investing theory, including an overview of investment incentives in the tax code, a comparison of “tax-drag” on various types of investments, a comparison of the tax implications of active versus passive strategies, and “asset location.” Practitioners who understand these tax driven strategies will have a superb opportunity to demonstrate their value to clients by providing guidance, planning, and tax expertise. Robert S. Keebler, CPA, MST, AEP (Distinguished) is a partner with Keebler & Associates, LLP and is a 2007 recipient of the prestigious Accredited Estate Planners (Distinguished) award from the National Association of Estate Planners & Councils. He has been named by CPA Magazine as one of the Top 100 Most Influential Practitioners in the United States and one of the Top 40 Tax Advisors to Know During a Recession. His practice includes family wealth transfer and preservation planning, charitable giving, retirement distribution planning, and estate administration. Mr. Keebler frequently represents clients before the National Office of the Internal Revenue Service (IRS) in the private letter ruling process and in estate, gift and income tax examinations and appeals, and he has received more than 150 favorable private letter rulings including several key rulings of “first impression”. He is the author of over 100 articles and columns and is the editor, author or co-author of many books and treatises on wealth transfer and taxation. Mr. Keebler has recently been quoted in The New York Times in an article titled: “The 1040 Blues” where he provided insight on capital gains tax.
