IRC Section 7702, which defines the qualifications for life insurance for tax purposes, remained unchanged for 30 years – that is, until a modification was approved and implemented in the space of a few short days at the end of 2020. The new Section 7702 modernizes the tax definitions of life insurance to meet the strains of a prolonged ultra-low interest rate environment, particularly for Whole Life. Secondarily, it appears to provide for incredible new planning opportunities for life insurance by allowing for higher funding levels per dollar of death benefit. But are the changes really as substantive as they first appear? Do they really open new opportunities or do they simply modify existing ones? And are the challenges with implementing the new rules worth the benefits? Join us to find out. Bobby Samuelson is the Executive Editor of The Life Product Review, the industry’s best source for independent and objective life insurance product intelligence. He has also authored and co-authored numerous articles appearing in publications such as Trusts and Estates and has been quoted in the Wall Street Journal. Previously, Bobby was the Senior Vice President and Head of Product Development for life insurance and annuities at Brighthouse Financial. Prior to joining MetLife in 2013, he was an independent consultant to life insurers, distributors and advisors. He is the third generation of his family to work in the life insurance industry.
