This presentation will provide a study of the Generation-Skipping Transfer Tax regime while simultaneously comparing & contrasting it with the Estate & Gift Tax regimes. We will examine the types of transactions to which the GSTT regime applies as well as transactions which are excepted from the GSTT. Consideration will also be giving to the concept of “who is the transferor” for purposes of applying the GSTT rules. After establishing the various possible applications of the GSTT rules and its exceptions, we will next explore planning opportunities with respect to the Lifetime GSTT Exemption Amount. Along with the discussion of GSTT planning issues, IRS filing issues will likewise be addressed. Finally, we will discuss solutions relating to the problematic partially exempt/partially non-exempt trust.
