Trust and Probate Legislation in Texas:
What the 2011 Legislative Session May Bring

Every two years our trust and probate codes have numerous changes. You may wonder: how do these changes happen or why hasn’t legislation which seems to have wide acceptance in other states (23 states have repealed or modified the Rule Against Perpetuities, not Texas), not occurred here. How does the legislative process work as it affects you and your clients, personally and professionally? What will happen this year? On November 4th, State Representative Will Hartnett (Dallas), Glenn Karisch of The Karisch Law Firm (Austin), and Debbie Cox of JPMorgan Private Bank (Dallas) will participate in a panel discussion of how our fiduciary laws are made and what we might expect to be considered in the 2011 state legislative session. Representative Hartnett is in his tenth term serving North Dallas and the 114th District. Hartnett, one of the most respected legislators in Austin, serves on the House Ways and Means Committee and the Judiciary and Civil Jurisprudence Committee, where most trust and probate legislation starts. He served for six years as Chairman of the House Judiciary Committee. Hartnett is a partner in The Hartnett Law Firm, which specializes in estate and trust administration and litigation, and he is a Fellow of the American College of Trust and Estate Counsel (ACTEC). He will describe the legislative process and his outlook for 2011. Glenn Karisch, whose practice focuses exclusively on estate planning, probate and trust law, is the past chair of the Real Estate, Probate and Trust Law Section of the State Bar of Texas. Karisch is also an ACTEC Fellow. He will review trust and probate legislation likely to be proposed by the State Bar in the upcoming session. Debbie Cox is managing director and wealth advisor for her institution and an ACTEC Fellow. She currently serves as Chairman of the Governmental Relations Committee for the Texas Bankers Association’s Wealth Management & Trust Division, which represents many professional fiduciaries throughout the state. She will provide an overview of legislation that professional fiduciaries in Texas are supporting or considering. Dave Folz, Texas Capital Bank (Dallas), a past Chairman of TBA’s Wealth Management & Trust Division Government Relations Committee from 2003-2007, will serve as moderator.
