“FIDUCIARY LITIGATION – SOME ATTITUDES OR ACTS THAT MIGHT GET YOU SUED, AND SOME STEPS THAT MIGHT GET YOU OUT

This is a discussion of some of the mistakes that fiduciaries make in dealing with their beneficiary that often serve as a trigger for litigation, coupled with a few tips on how to get out of the trap if litigation is looming and a few more on how to avoid getting hit with a personal judgment.  Jim Hartnett graduated from Austin College and earned his JD from The University of Texas.  He is a partner with the Hartnett Law Firm in Dallas.  He was voted The Texas Lawyer’s “Go To” lawyer in Trusts and Estates in 2003, The Texas Lawyer’s “Top Notch” lawyer in Trusts and Estates, 2007 and  finalist for The Texas Lawyer’s 2012 “Go To” lawyer in Trusts and Estates, Best Lawyers in America, listed under Trusts & Estates and D Magazine’s Best Lawyers in Dallas, listed under Trusts & Estates.  In addition to his practice, Jim is a frequent author and lecturer on estate planning issues.
